Multidistrict Litigation Is Better Than Joining a Hip Replacement Class Action Lawsuit
When a product such as DePuy Orthopaedics’ recalled ASR XL Acetabular System or ASR Hip Resurfacing System injures many people, recipients often believe that the best method of obtaining compensation is by joining a hip replacement class action suit. They suspect that other injured people will sue the same manufacturer, and that the efficient process of class action lawsuits will save them time and money (in the form of legal fees). Consequently, class action lawsuits tend to be best for situations where the plaintiffs’ injuries are monetary—and uniform—in nature.
By contrast, MDL allows plaintiffs to retain their individual cases yet still benefit from a streamlined pre-trial process similar to that of a class action. One of the parties files a motion with the U.S. Judicial Panel on Multidistrict Litigation, which decides whether to consolidate the cases and send them to a “transferee judge” within the federal court system. All MDL proceedings occur before this judge, whose rulings apply to all parties’ cases, and before whom all pretrial motions and discovery (the pretrial information-gathering process) takes place. Then the court schedules a group of bellwether (early) trials to help all parties gauge the potential outcomes of their own cases. Some will typically settle out of court, while others go to trial themselves.

Just as important as it is to be compensated for injures caused by a medical device, there are many of us that will never be compensated enough for things we have lost, health,finaancial, time lost with young children and grandchildren, family relationship etc etc.
Taking legal action is great, however, changing the laws are just as important. Laws that will provide a means of protection for the quality of life of a human being first, medical device manufacturer second. Contacting those people that can make changes in the laws as they exist today is a key fact of importance. So, write to your senators, congressman, lobbyist anyone that can be instrumental in making these changes. Unless we make change, we will continue to be vulnerable to another disaster such as we are experiencing with metal on metal hip devices.

I had a Birmingham hip replacement done in California approximately 4 yrs. ago. I have had problems with it, but 3 months ago, I developed a severe bone infection in femur just below the implant. The Ortho Surgeon said it will take 3 surgeries to fix this problem. First, he must remove the ball and stem which is causing the infection and replace it with some temporary brace. Then the wound care center must surgically implant a spacer bar and slow release antibiotics for 6 weeks to try to clear the infection in the bone. If that is cleared up, then the Ortho Surgeon must go in a do a regular full hip replacement. It has been a nightmare and there is still more to come it seems.
