Preliminary Discovery Underway In DePuy Pinnacle Hip Replacement MDL.

 

Discovery Stay Lifted; Litigation Progresses To Next Stage

 

Following the judicial appointments, Judge Kinkeade lifted a stay of discovery. Discovery has been stayed in this litigation since June 29, 2011.** Now that leadership roles have been assigned and a Special Master appointed, discovery and motion practice can move forward. The initial discovery process will likely involve the identification and noticing certain witnesses for depositions. In addition to naming DePuy hip replacement lawyers to leadership roles, and appointing Special Master James M. Stanton, the U.S. Judicial Panel on Multidistrict Litigation transferred three additional hip replacement lawsuits to the Pinnacle hip MDL.***
