DePuy ASR victim has suit returned to state court

A DePuy ASR hip replacement victim recently experienced a small victory against DePuy Orthopaedics, Inc. by having her lawsuit sent back to Wisconsin state court. DePuy Orthopaedics attempted to argue that the case should be brought to federal court for Multi District Litigation.
MDL proceedings are more complicated and extensive than those of state courts. In keeping the case in state court, the lawsuit will be quicker and easier for the victim.
An attorney in the case stated, “This is a lady who is suffering greatly because of a catastrophically defective product. She is in pain and shouldn’t have to wait for the MDL.”
