Under the agreement, according to people briefed on the plan, the medical products giant will pay some $2.475 billion in compensation to an estimated 8,000 patients who have been forced to have the all-metal artificial hip removed and replaced with another device.

Separately, the company has agreed to pay all medical costs related to such procedures, expenses that could raise the deal’s cost to Johnson & Johnson to some $3 billion, said those familiar with the proposal, who did not want to be identified.

The typical patient payment for pain and suffering caused by the device will be about $250,000 before legal fees, under the plan. Based on standard agreements, plaintiffs’ lawyers would receive about one-third of the overall payout, or more than $800 million, with those who negotiated the plan emerging as big winners.

Johnson & Johnson has tentatively agreed to a settlement that could reach up to $4 billion to resolve thousands of lawsuits filed by patients injured by a flawed all-metal replacement hip, said two lawyers briefed on the plan.

The tentative plan, which must win court approval, represents one of the largest payouts for product liability claims involving a medical device.

A spokeswoman for the company’s DePuy Orthopaedics unit declined to comment on the possibility of a settlement. An announcement about the plan is expected in the coming days, the lawyers said.

The agreement will include those patients who have already been forced to have the device, known as the Articular Surface Replacement, or A.S.R., removed and replaced with another artificial hip, said the lawyers who spoke about the agreement only on the condition of anonymity.

Under the deal, each patient would receive about $350,000 on average in compensation, though that figure will vary depending on factors like a patient’s age and medical condition.

The precise value of the settlement is unclear because lawyers for patients are still trying to estimate how many of the 12,000 related lawsuits involve patients who had a replacement. Lawyers believe that number may be 7,000 to 8,000 cases.

The final cost of the deal to Johnson & Johnson could rise, depending on how many claimants who received the device undergo replacement operations in the future, the lawyers said. Under the plan, patients who have not had a replacement would not receive compensation, the lawyers said.

Among the 9,000 hip implant procedures done by HSS annually, 10% are revisions.

Researchers compared 50 patients who had unexplained pain to a control group of 48 patients who came to HSS with infection, fracture misalignment or loosening of the hip. They measured adverse tissue reaction to metal ions and conducted a wear analysis on removed implants.

Among the group with unexplained pain, 60% had moderate to high rate of tissue reaction and 12% had a buildup of metal ions in soft tissues. The age, sex, body mass, size and length of the implant did not seem to explain pain and patients in both groups had similar wear on the implants. Some patients had a lot of tissue damage, but that was not related to wear, suggesting other factors are causing the damage.

When metal hips were introduced, the industry thought MoM hips were a positive innovation in their ability to remain well-lubricated which minimizes wear, but the thousands of lawsuits filed by injured patients tell another story.

Metal-on-metal hip implants have unique risks. In a MoM hip, the ball and socket is made of metal, usually chromium and cobalt. The metal components can come in contact during walking or running which can release metal particles around the implant, the tissue and surrounding muscles. The scientific community believes the metal ions causes damage that is irreversible and can lead to an early revision of the hip implant.

The suggestion is for doctors to closely follow hip implant patients with unexplained pain before there is significant tissue damage.

AAOS members also sang the praises of a total hip replacement (THR) concluding itincreases the life span and reduces the risk of heart failure, depression and diabetes among the 43,000 Medicare patients with osteoarthritis that were studied.

Abstract

Over 400,000 total knee replacement procedures (TKR) are performed annually in the United States. This paper focuses on the development of a battery-less wireless instrumented tibial tray for performance feedback in TKR implants. The proposed instrumented tibial tray is powered internally by an integrated piezoelectric energy harvesting system. Energy is harvested during the walking of the patient when forces are exerted on the tibial component. The sensors and wireless electronics are entirely powered from the harvested energy.

This tibial tray is also instrumented with capacitive force sensors and an ultra low-power method to measure the capacitive force sensors. A bench top test rig is developed for testing the battery-less wireless knee replacement implant. For a person with a body weight of 55 kg, the energy harvesting system can fully charge the storage capacitors in 11 steps and can harvest an average of 1051 μJ per step.

To power the force measurement system for ten seconds and to transmit the data, the piezoelectric energy harvesting system must be charged before the force measurement process is initiated by a minimum of 11 steps and a minimum of two steps must be taken during the force measurement process. During the force measurement process, each force sensor is sampled at a frequency of 10 Hz for ten seconds; thereafter, all of the data is transmitted to the RF base station. The resulting capacitive force sensors adequately represented cyclic loads; however, the sensors demonstrated some issues with repeatability.

Device:

Metal-on-metal hip implants consist of a ball, stem and shell, all made from cobalt-chromium-molybdenum alloys.

There are two types of metal-on-metal hip implants:

Traditional total hip replacement systems

Resurfacing hip systems

Purpose: In February 2011, the FDA launched a metal-on-metal hip implant webpage. The FDA is providing updated safety information and recommendations to patients and health care providers. This new information is based on the FDA’s current assessment of metal-on-metal hip implants, including the benefits and risks, the evaluation of the published literature, and the results of the June 2012 Orthopaedic and Rehabilitation Devices Advisory Panel meeting.

Summary of Problem and Scope:

Metal-on-metal hip implants have unique risks in addition to the general risks of all hip implants.

In metal-on-metal hip implants, the metal ball and the metal cup slide against each other during walking or running. Metal can also be released from other parts of the implant where two implant components connect. Metal release will cause some tiny metal particles to wear off of the device around the implant, which may cause damage to bone and/or soft tissue surrounding the implant and joint. This is sometimes referred to as an “adverse local tissue reaction (ALTR)” or an “adverse reaction to metal debris (ARMD).”

Soft tissue damage may lead to pain, implant loosening, device failure and the need for revision surgery (a surgical procedure where the implant is removed and another is put in its place). Some of the metal ions released will enter the bloodstream and travel to other parts of the body, where they may cause symptoms or illnesses elsewhere in the body (systemic reactions).

Presently, the FDA does not have enough scientific data to specify the concentration of metal ions in a patient’s body or blood necessary to produce adverse systemic effects. In addition, the reaction seems to be specific to individual patients, with different patients having different reactions to the metal wear particles.

Recommendations for Orthopaedic Surgeons:

Before Surgery

Select a metal-on-metal hip implant for your patient only after determining that the benefit-risk profile of using a metal-on-metal hip implant outweighs that of using an alternative hip system (metal-on-polyethylene, ceramic-on-polyethylene, ceramic-on-ceramic or ceramic-on-metal). Factors to consider include the patient’s age, sex, weight, diagnosis, and activity level.

Note that a 2012 FDA advisory panel of experts identified young males with larger femoral heads as the best candidates for hip resurfacing systems.

Inform patients about the benefits and risks of metal-on-metal hip implants, including the risk that the hip implant may need to be replaced. Also discuss the patient’s expectations and review the potential complications of surgery with a metal-on-metal hip implant.

Pay close attention to patient populations for which metal-on-metal hip systems are contraindicated. Be aware of the risk factors that may predispose a device to excess wear and early failure.

Additional information on the FDA’s recommendations for orthopaedic surgeons before, during and immediately following metal-on-metal hip replacement surgery can be found in Information for Orthopaedic Surgeons.

Patient Follow-Up

Follow-up of asymptomatic patients with metal-on-metal hip implants, including physical examinations and routine radiographs, should occur periodically (typically every 1 to 2 years). If the hip is functioning properly, the FDA does not believe there is a clear need to routinely perform additional soft tissue imaging or assess metal ion levels in the blood.

Be aware that there are certain patients who are at risk for increased device wear and/or adverse local tissue reactions (ALTR) and should be followed more closely. They may include:

Patients with bilateral implants

Patients with resurfacing systems with small femoral heads (44mm or smaller)

Female patients

Patients receiving high doses of corticosteroids

Patients with evidence of renal insufficiency

Patients with suppressed immune systems

Patients with suboptimal alignment of device components

Patients with suspected metal sensitivity (e.g. cobalt, chromium, nickel)

Patients who are severely overweight

Patients with high levels of physical activity.

Pay close attention to signs and symptoms that may be associated with metal-on-metal hip implants. Please see the website for a list of common ALTRs and systemic symptoms/complications.

Conduct a thorough evaluation if a patient with a metal-on-metal hip experiences local symptoms such as pain or swelling at or near the hip, a change in walking ability or a noise from the hip joint more than three months after metal-on-metal hip implant surgery.

Follow symptomatic patients with metal-on-metal hip implants at least every 6 months.

Additional information on the FDA’s recommendations for patient follow-up can be found in Information for Orthopaedic Surgeons.

For additional information regarding soft tissue imaging or assessing metal ion levels, please review the FDA’s recommendations below.

Imaging

For some symptomatic patients with metal-on-metal hip implants, additional diagnostic imaging is required to assess and diagnose soft tissue findings surrounding the implant. Please be aware of the FDA’s recommendations:

Consider the benefits and risks of using different types of diagnostic imaging procedures (e.g. MRI with metal artifact reduction, CT, or ultrasound) as well as the availability of specialized radiology expertise when determining the most appropriate imaging modality for each patient.

If you determine that an MRI of a metal-on-metal hip implant patient is appropriate, the FDA recommends the following:

Consult with the radiologist to evaluate the benefits and risks of utilizing MRI with metal artifact reduction;

Review the available device-specific labeling from manufacturers for MRI Conditions; and

Inform the MRI site that the patient has a metal-on-metal hip implant.

For additional information on the FDA’s recommendations about imaging a patient with a metal-on-metal hip implant, please see Imaging Evaluation.

Assessing Metal Ion Levels

Some patients with a metal-on-metal hip implant may have elevated metal ion levels (e.g. cobalt and/or chromium) in their bloodstream. Several factors can impact the accuracy, reproducibility, and clinical interpretation of metal ion test results. Please be aware of the FDA’s recommendations:

The FDA does not believe there is a clear need to routinely check metal ion levels in the blood if the orthopaedic surgeon feels the hip is functioning properly and the patient is asymptomatic.

Patients with metal-on-metal hip implants who develop any symptoms or physical findings that indicate their device may not be functioning properly, should be considered for metal ion testing.

If measuring metal ions, consider obtaining and following serial measurements (using the same sample type, the same measurement method, and preferably the same laboratory) in determining metal ion levels in symptomatic patients.

At this time, the FDA is not recommending a specific metal ion level as a trigger for revision or other medical intervention. The metal ion concentration values, including increases in metal ion levels over time, should be considered in addition to the overall clinical scenario including symptoms, physical findings, and other diagnostic results when determining further actions.

For additional information on the FDA’s recommendations on metal ion test methods, selecting a test lab and interpreting test results, please see Metal Ion Testing.

Device Revision

The decision to revise a metal-on-metal hip implant should be made in response to the overall clinical scenario. In case of adverse local tissue reactions (ALTR), revision of a metal-on-metal hip implant may have a worse prognosis than revision of other types of bearing surfaces.

In selecting components for revision:

Consider the benefits and risks of all bearing surfaces for each patient.

Check the specific device labeling for compatibility of device components.

If a patient is suspected to have developed metal sensitivity, carefully select the materials of the revision components (potentially avoiding materials with nickel or chromium).

For additional information, please review the FDA’s considerations on device revisions, which includes our recommendation for a retrieval analysis of every failed metal-on-metal hip implant.

*For chromium testing, a validated method that resolves potential interferences must be used. Please reviewFDA’s recommendations for chromium testing.

Recommendations for Health Care Providers:

Metal-on-metal implant patients with systemic symptoms are more likely to visit their primary care practitioner than their orthopaedic surgeon, which makes it important for all health care providers to be aware of metal ion adverse events that may occur in metal-on-metal hip implant patients. Based on case reports, these events may include:

General hypersensitivity reaction (skin rash)

Cardiomyopathy

Neurological changes including sensory changes (auditory, or visual impairments)

Psychological status change (including depression)

Renal function impairment

Thyroid dysfunction (including neck discomfort, fatigue, weight gain or feeling cold.

Patients with systemic findings that are thought to be related to a metal-on-metal hip implant should be advised to follow-up with his or her orthopaedic surgeon to determine the appropriate course of action.

For additional information, please review the FDA’s considerations to Health Care Professionals.

Recommendations for Patients Considering Hip Implants:

Be aware that every hip implant has benefits and risks.

Discuss your options for hip surgery with your surgeon.

A list of some questions to ask your orthopaedic surgeon can be found in Patients Considering a Metal-on-Metal Hip Implant.

Recommendations for Patients with Metal-on-Metal Hip Implants:

If you are not having any symptoms and your orthopaedic surgeon believes your implant is functioning appropriately, you should continue to routinely follow-up with the surgeon every 1 to 2 years.

If you develop new or worsening problems such as pain, swelling, numbness, noise (popping, grinding, clicking or squeaking of your hip), and/or change in your ability to walk, contact your orthopaedic surgeon right away.

If you experience changes in your general health, including new or worsening symptoms outside your hip, let your physician know you have a metal-on-metal hip implant.

Additional information for patients with a metal-on-metal hip can be found in Patients who have a Metal-on-Metal Hip Implant.

FDA Activities:

The FDA is committed to providing reliable safety recommendations to patients and health care providers about the utilization of these devices. Recent activities include:

On May 6, 2011, the FDA instructed manufacturers of metal-on-metal total hip replacement (THR) systems to conduct postmarket surveillance study of these devices. Five manufacturers currently market metal-on-metal hip implants in the U.S. and all five have approved postmarket surveillance study plans. Data from these studies will provide patients and health care providers with additional information about the safety profiles of the implants, including the effect of metal ion concentrations in the bloodstream.

On June 27-28, 2012, the FDA convened the Orthopaedic and Rehabilitation Devices Panel of the Medical Devices Advisory Committee to seek expert scientific and clinical opinion on the benefits and risks of metal-on-metal hip systems. Information from this panel meeting has helped form these recommendations.

On January 17, 2013 the FDA issued a proposed order requiring manufacturers of metal-on-metal total hip replacement systems to submit premarket approval (PMA) applications. Metal-on-metal total hip replacement systems were evaluated under the 510(k) premarket notification program. Metal-on-metal total hip replacement systems were marketed in the U.S. prior to 1976 legislation that gave the agency premarket authority over medical devices. As “preamendment devices,” they were designated as Class III (higher risk) devices but were regulated under the 510(k) premarket notification program.

Additional information on FDA ongoing activities are provided in FDA’s Role and Activities.

Reporting Problems to the FDA:

Prompt reporting of adverse events can help the FDA identify and better understand the risks associated with medical devices. If you suspect a problem with a metal-on-metal device, we encourage you to file a voluntary report through MedWatch, the FDA Safety Information and Adverse Event Reporting program. Health care personnel employed by facilities that are subject to the FDA’s user facility reporting requirements should follow the reporting procedures established by their facilities. Device manufacturers must comply with the Medical Device Reporting (MDR) regulations.

Reports to the FDA about adverse events related to metal-on-metal hip systems include, but are not limited to: pain, malposition, adverse local tissue reaction, metallosis, hypersensitivity (allergy), loosening, and dislocation.

To help us learn as much as possible about the adverse events associated with metal-on-metal hip implants, please include the following information in your reports, if available:

Date of implantation

Date of implant removal (if applicable)

Clinical cause for revision (if available)

System components affected by the adverse event.

I disagree with how your editorial described company actions regarding ASR testing, data analysis and communications.

ASR was tested for years before receiving regulatory clearance around the world. Once on the market, we carefully considered all the data and investigated product complaints individually, while also looking for broader performance trends. We continued to share appropriate and validated data with regulators and surgeons.

When we received new registry data reporting that ASR patients were undergoing a second hip replacement surgery sooner than expected, we recalled the product and immediately supported patients with a reimbursement program for their medical costs.

They have taken up the mantle that I have always believed in that any metal on metal implant can’t possibly work purely down to common sense.

In my own experience I have contacted over 6 legal firms who have rejected me and 2 who have seemed to ‘ take me on’ have had proof of identity and so on and have never heard a word back and in all instances the actual reason for taking any action(s) have not been discussed and in some cases I have been advised that I am almost beyond the ’3 year criteria’. I had no idea that this is not the case. Now I know this is not the case.
Herewith the statement from Lampkins which I hope will help all sufferers understand their legal position and call Lampkins to that effect. (Please note no monies are involved).

Lampkin & Co Solicitors are progressing legal action in the UK for the failure of all metal-on-metal hip products. They are one of only a handful of law firms that have the necessary expertise to deal with these cases.

When the news regarding the scale of the problem with the metal-on-metal hip products broke in the UK, many solicitor practices saw an opportunity and initially took on compensation claims for those suffering following their hip replacement procedures. Unfortunately, many of those firms did not have the necessary experience to deal with these cases and have now either started to reject the claims or simply lower their priority in the workload which means those clients are now finding they’re not getting anywhere.

There are a number of common misconceptions regarding the legal action in the UK. Some helpful pointers for anyone that is suffering due to their metal-on-metal hip replacement are:

The cases are being dealt with as a product liability matter, not personal injury or medical negligence.

This means it’s the manufacturer of the metal-on-metal hip product itself that action is taken against, not any medical staff such as your surgeon for example.

It also means the time limitations under law for taking such action is actually longer than a personal injury case. For product liability it’s 10 years from the date of manufacture. It’s important to note though that some of the metal-on-metal hip products may have been in stock at hospitals for up to 2 years in some cases before being fitted and the legal action itself will take some time to complete.

Due to the time scales involved in these cases Lampkin & Co are only taking on cases where your procedure took place in 2005 and onwards.

The law regarding the funding of legal costs in the UK is actually due to change on April 1st 2013. Currently, Lampkin & Co are able to guarantee their clients will receive 100% of any compensation they are awarded but following the changes, any cases taken on will have up to 25% of the compensation deducted towards legal costs. This means you should act now as the deadline for taking on a case under the current arrangements is March 28th 2013.

If you have already approached another law firm and either had your case rejected or your case has been taken on and you feel unhappy about how it’s being handled you have the right to appoint another solicitor. You can actually transfer your case at no cost or risk to you – Lampkin & Co can advise you regarding this process.

Lampkin & Co are currently representing over 100 patients and taking several new enquiries each day. All cases are being dealt with under a “No Win No Fee” arrangement so provided you follow their advice, you shouldn’t see a bill from them regardless of the outcome of your case.

Hours before critical coverage from the British Medical Journal and the BBC, the Medicines and Healthcare products Regulatory Agency (MHRA) issued new guidelines on larger forms of ‘metal-on-metal’ (MoM) hip implants. Advice on smaller metal devices or those featuring a ceramic head has not changed. Previously, guidelines suggested larger MoM implants should only be checked annually for five years after surgery. The agency now says the annual check-ups should be continued for the life of the implant. Check-ups, they say, are a precautionary measure to reduce the “small risk” of complications and the need for further surgery.

Together with the recent controversy over PIP breast implants, the news has caused the media and patient groups to call for tighter regulation of medical devices, perhaps bringing the approval process into line with that of medicines. Before they can be approved for wider use drugs must undergo several years of laboratory, animal and human testing .

What types of implants are involved?

There are numerous designs and materials used to make hip implants. In recent days the MHRA has issued major updates to its advice on a type of metal-on-metal (MoM) hip replacement. As the name implies, MoM implants feature a joint made of two metal surfaces – a metal ‘ball’ that replaces the ball found at the top of the thigh bone (femur) and a metal ‘cup’ that acts like the socket found in the pelvis.

What should I do if I have a hip implant?

Consult your doctor if you do not know which type of implant you have or if you have any concerns about your hip replacement. The new guidance only applies to large head metal-on-metal implants, which have been used in only a minority of hip replacements. Patients who have MoM implants should ensure they attend any follow-up appointments as usual, and can consult the hip implant pages on NHS Choices for any further updates.

Consult your doctor if you have any of the following symptoms:

pain in the groin, hip or leg

swelling at or near the hip joint

a limp or problems walking

These symptoms do not necessarily mean that your device is failing, but they do need investigating.

Any changes in general health should also be reported, including:

chest pain or shortness of breath

numbness or weakness

changes in vision or hearing

fatigue

feeling cold

weight gain

change in urination habits

The MHRA’s updated advice concerns the type of MoM implant in which the head of the femur is 36mm or greater. This is often referred to as a ‘large head’ implant. The agency now says that patients fitted with this type of implant should be monitored annually for the life of the implant, and that they should also have tests to measure levels of metal particles (ions) in their blood. Patients with these implants who have symptoms should also have MRI or ultrasound scans, and patients without symptoms should have a scan if their blood levels of metal ions are rising. The previous guidance on this type of hip implant, issued in April 2010, advised that patients should be monitored annually for no fewer than five years.

What about other types of hip implants?

Advice on monitoring patients with other types of hip implants remains the same, and guidance has not changed on:

MoM hip resurfacing implants – where the socket and ball of the hip bone has a metal surface applied to it rather than being totally replaced.

Total MoM implants where the replacement ball is less than 36mm wide.

A particular range of hip replacements called DePuy ASR – these hip replacements were recalled by their manufacturer, DePuy, in 2010 because of high failure rates. The company made three types of ASR implant.

Implants featuring ceramic heads.

How many people are affected?

It is estimated that, in total, 49,000 people in the UK have been given metal-on-metal implants with a width of 36mm or above. This represents a minority of the patients given hip replacements, who mostly have devices featuring plastic, ceramics or smaller metal heads.

In 2010 there were 68,907 new hip replacements fitted, and approximately 1,300 of these surgeries used an MoM implant sized 36mm or above – a rate of around 2%.

What exactly is the problem with MoM implants?

All hip implants will wear down over time as the ball and cup slide against each other during walking and running. Although many people live the rest of their lives without needing their implant to be replaced, any implant may eventually need surgery to remove or replace its components. Surgery to remove or replace part of the implant is known as ‘revision’ and, of the 76,759 procedures performed in 2010, some 7,852 were revision surgeries.

However, data now suggest that large head MoM hip implants (those with a width of 36mm or greater) wear down at a faster rate than other types of implants. As friction acts upon their surfaces it can cause tiny metal particles (medically referred to as ‘debris’) to break off and enter the space around the implant. Individuals are thought to react differently to the presence of these metal particles, but, in some people, they can trigger inflammation and discomfort in the area around the implant. Over time this can cause damage and deterioration in the bone and tissue surrounding the implant and joint. This, in turn, may cause the implant to become loose and cause painful symptoms, meaning that further surgery is required.

News coverage has also focused on the MHRA’s recommendation to check for the presence of metal ions in the bloodstream, potentially released either from debris or the implant itself. Ions are electrically charged molecules. Levels of ions in the bloodstream, particularly of the cobalt and chromium used in the surface of the implants, may, therefore, indicate how much wear there is to the artificial hip.

There has been no definitive link between ions from MoM implants and illness, although there has been a small number of cases in which high levels of metal ions in the bloodstream have been associated with symptoms or illnesses elsewhere in the body, including effects on the heart, nervous system and thyroid gland.

The MHRA points out that most patients with MoM implants have well functioning hips and are thought to be at low risk of developing serious problems. However, a small number of patients with these hip implants develop soft tissue reactions to the debris associated with some MoM implants.

How are medical devices regulated?

In the UK, the MHRA is the government agency responsible for ensuring that medical devices work and are safe. The MHRA audits the performance of private sector organisations (called notified bodies) that assess and approve medical devices. Once a product is on the market and in use, the MHRA has a system for receiving reports of problems with these products, and will issue warnings if these problems are confirmed through their investigations. It also inspects companies that manufacture products to ensure they comply with regulations.

This system differs greatly from that for testing and approving drugs. Drugs require several years of research testing and trials before they can be approved for clinical use.

What action have regulators taken?

The MHRA has convened an expert advisory group to look at the problems associated with MoM implants. This meets regularly to assess new scientific evidence and reports from doctors and medical staff treating patients. The agency says it is continuing to monitor closely all the latest evidence about these devices and may issue further advice in the future.

In the US, the Food and Drug Administration (FDA) says it is gathering additional information about adverse events in patients with MoM implants. In the meantime, it advises patients with MoM hip implants who have no symptoms to attend follow-up appointments as normal with their surgeon. Patients who develop symptoms should see their surgeon promptly for further evaluation.

What actions have critics called for?

In light of the PIP breast implant controversy and this new information on hip implants, there is currently intense scrutiny on the way medical devices are regulated in the UK and Europe, with patient groups and the media arguing that medical devices should be regulated in a similar way to medicines.

Clearing a medicine for use in the UK is a lengthy process involving several stages of laboratory and animal testing, and then carefully controlled and monitored tests in humans. Only once there is enough evidence to suggest that a medicine is reasonably safe can it enter clinical use, and even then patients will be monitored to look at the longer-term effects of the drug.

However, medical devices are not required to go through human trials before entering use, and can currently be approved on the basis of mechanical tests and animal research. While certain devices, such as hip implants, have been monitored through systems such as the National Joint Registry, in light of the recent health concerns over PIP breast implants, patient groups are calling for more testing before devices are allowed into clinical use, and closer mandatory monitoring schemes to ensure their safety once they enter the market.

Study shows cost-effectiveness and benefits to patients of early hip replacement

Early access to hip replacement is cost-effective and provides significant benefits for patients’ quality of life, a study has shown.

Ruben Mujica-Mota, from the University of Exeter Medical School, carried out research comparing early access and delayed hip replacement surgery in Italy on behalf of the European Health Technology Institute for Socio-Economic Research (EHTI). His findings, which are now published in the journal Value in Health, demonstrate both the cost-effectiveness of early hip replacement, as well as the benefits for patients. The expert says that delaying hip replacement surgery does not cut costs for health services and denies patients the opportunity to lead an active and healthy life while awaiting surgery. He claims that even young adults do not benefit from postponing treatment – an approach that is sometimes taken to reduce the risk of revision surgery during their lifetime.

Ruben Mujica-Mota, senior lecturer in Health Economics at the University of Exeter, concluded: “This research clearly suggests that the cost savings to national health systems in Europe brought about by delaying total hip replacement may not justify the large quality of life losses to patients.” Yves Verboven, executive director of the EHTI, said that delaying hip replacement among patients with severe osteoarthritis has “limited value in reducing the total cost of treatment”.

He added: “On the contrary, a strategy of not postponing total hip replacement surgery provides a significant benefit to patients.” A spokeswoman for Arthritis Research UK said: “You won’t necessarily need a hip replacement if you have arthritis of the hip, but it is worth considering if your hip is severely damaged by arthritis and the pain, disability and stiffness are having serious effects on your daily activities.” Provided by University of Exeter

The doctor, who also worked as a consultant to Johnson & Johnson, wrote the note nearly two years before the company recalled the device in 2010. And it was far from the only early warning those executives got from doctors who were paid consultants. Still, the company’s DePuy orthopedic unit plowed ahead, and those consultants never sounded a public alarm to other doctors, who kept implanting the device.

The memos have recently emerged during the trial of the first of more than 10,000 patient lawsuits brought against Johnson & Johnson over the hip implant device, the Articular Surface Replacement, or A.S.R. The company has insisted that it acted responsibly in determining when to halt its sale. But plaintiffs’ lawyers have offered a portrait of executives who put profits ahead of patients, even scuttling a plan to fix the implant because it cost too much.

It might not be surprising to find that executives acted to protect a company’s bottom line. Still, the Johnson & Johnson episode is also illuminating a broader medical issue: while experts say that doctors have an ethical obligation to warn their peers about bad drugs or medical devices, they often do not do so.

“Questioning the status quo in medicine is not easy,” said Dr. Harlan Krumholz, a professor at Yale School of Medicine.

Physicians may remain silent for a variety of reasons, he and other experts said. They may fear that speaking out could get them sued or believe that a product problem was an anomaly or their fault.

Doctors also have an aversion to reporting. For instance, while the Food and Drug Administration relies on physicians to help monitor product safety by alerting the agency to adverse patient reactions, doctors usually do not make such filings, saying they are too busy for the paperwork.

“The standard in the medical community is not to report,” said Dr. Robert Hauser, a cardiologist who, along with a colleague, warned other doctors in 2005 about a defective heart implant.

There is another reason doctors may choose to remain silent, experts say: their financial ties to a drug or device maker.

For years, such consulting payments have raised concerns about the impact of money on a doctor’s decision about which drugs to prescribe or how to interpret research findings. Money can also shift a physician’s sense of loyalty, said George Loewenstein, a professor at Carnegie Mellon University who has studied medical conflict-of-interest policies. “If someone has been paying you or employing you, it is very difficult to blow the whistle,” said Professor Loewenstein, who teaches economics and psychology. “It offends our sense of loyalty.”

Dr. Krumholz said he also believed that such loyalties were between a doctor and a company’s executives, rather than with a company or its brand. Over time, a physician may come to see his relationships with those officials in terms of friendship, while companies see an influential doctor as an asset who helps develop products and boost sales.

For a consultant, breaking those ties can carry a cost. For example, when Dr. Lawrence D. Dorr, an orthopedic specialist, warned fellow surgeons in an open letter in 2008 that a hip implant made by Zimmer Holdings was flawed, he became the subject of a whisper campaign that questioned his skills as a surgeon.

“The first thing that a company does is to put out a campaign that a surgeon does not know how to operate,” said Dr. Dorr, who was a consultant to Zimmer when he wrote the letter. “It hurt my practice for a year.”

TRADITIONALLY, doctors have brought problems to the attention of colleagues by conducting research and publishing their findings in a medical journal. The advantage of that system helps ensure the credibility of study data and protects a researcher from random attack, said Dr. David Blumenthal, the president of the Commonwealth Fund, a group that studies health policy issues.

But getting a study published can take a year or two; some Johnson & Johnson consultants did publish studies about the hip’s flaws, but they largely appeared after it had been recalled.

Dr. Blumenthal said there was probably a need for more immediate ways for doctors to share their concerns, like forums supported by professional medical organizations. Another approach would be to have companies hire doctors as consultants whose sole concern was product safety, Professor Loewenstein said.

The results of not speaking out are playing out in a Los Angeles courtroom, where the first Johnson & Johnson hip case is unfolding. In the years before the implant’s recall, a British physician, Dr. Antoni Nargol, and a colleague were among those who tried to alert surgeons to the problem.

But the silence of other doctors apparently gave company executives the upper hand; in meetings with Dr. Nargol, they said that he seemed to be the only doctor having trouble.

He said recently, “They told me there were no other problems.”
