<p>WASHINGTON — IN the last few days of negotiations in Congress, repeal of the <a class="zem_slink" title="Patient Protection and Affordable Care Act" href="http://en.wikipedia.org/wiki/Patient_Protection_and_Affordable_Care_Act" target="_blank" rel="wikipedia">Affordable Care Act</a>’s tax on <a class="zem_slink" title="Medical device" href="http://en.wikipedia.org/wiki/Medical_device" target="_blank" rel="wikipedia">medical devices</a> emerged as a key Republican demand. The medical-device industry waged an intense lobbying campaign — even garnering the support of many Democrats who favored the law — arguing that the tax would stifle innovation and increase health care costs.</p>
<p>This argument is doubly disingenuous. Not only can the medical-device industry easily afford the tax without compromising innovation, but the industry’s enormous profits are a result of anticompetitive practices that themselves drive up medical-device costs unnecessarily. The tax is a distraction from reforms to the industry that are urgently needed to lower health care costs.</p>
<p>The medical-device industry faces virtually no price competition. Because of confidentiality agreements that manufacturers require hospitals to sign, the prices of the devices are cloaked in secrecy. This lack of transparency impedes hospitals from sharing price information and thus knowing whether they are getting a good deal.</p>
<p>Even worse, manufacturers often maintain personal relationships (sometimes involving financial payments like consulting fees) with physicians who choose the medical devices that their hospitals purchase, creating a conflict of interest. Physicians often don’t even know the costs of the devices, and individual physicians often choose devices on their own, which weakens a hospital’s ability to bargain for volume discounts.</p>
<p>Such anticompetitive practices help generate a wide variation in the prices of medical devices — and contribute to higher prices in general. For example, the Government Accountability Office found that prices for cardiac implantable medical devices in the <a class="zem_slink" title="United States" href="http://maps.google.com/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h" target="_blank" rel="geolocation">United States</a> vary by several thousand dollars. And even the lowest-priced devices in the United States are expensive compared with those in other developed countries. According to the consulting firm <a class="zem_slink" title="McKinsey &amp; Company" href="http://www.mckinsey.com" target="_blank" rel="homepage">McKinsey</a> &amp; Company, the United States spends about 50 percent more than expected on the top five medical devices, compared with Europe and Japan. McKinsey calculates that this amounts to $26 billion in excessive spending each year. <a title="Recent and archival health news about Medicare." href="http://topics.nytimes.com/top/news/health/diseasesconditionsandhealthtopics/medicare/index.html?inline=nyt-classifier">Medicare</a>, private health insurers and patients end up paying these inflated prices.</p>
<p>Excessive prices fuel enormous profits — profits that dwarf both the medical-device tax and the industry’s investments in research and development. Consider the device division of <a class="zem_slink" title="NYSE: JNJ" href="http://www.google.com/finance?q=NYSE:JNJ" target="_blank" rel="googlefinance">Johnson &amp; Johnson</a>, which in 2012 had an operating profit of $7.2 billion. By the company’s own estimate, the device tax would amount to at most $300 million, and its investment in research and development amounts to only $1.7 billion.</p>
<p>There are several ways policy makers could lower device costs. The first step would be to end the anticompetitive practices that prevent hospitals from getting the best deals. Senator <a class="zem_slink" title="Chuck Grassley" href="http://www.grassley.senate.gov/" target="_blank" rel="homepage">Charles E. Grassley</a>, Republican of Iowa, has sponsored legislation that would foster transparency by posting online price information for implantable medical devices.</p>
<p>In addition, instead of simply paying hospitals based in part on what they have spent on devices, <a class="zem_slink" title="Medicare (United States)" href="http://en.wikipedia.org/wiki/Medicare_%28United_States%29" target="_blank" rel="wikipedia">Medicare</a> should force manufacturers to compete for business based on a product’s price and quality.</p>
<p>Medicare should also pay hospitals a single lump sum for all of the associated costs of a given procedure (like a hip replacement). This approach, known as “bundling” the costs, would create incentives for hospitals to lower device costs. Savings should be shared with the physicians, so that their incentives are aligned with the hospital’s.</p>
<p>Bundling has been used successfully in pilot programs. Under Medicare’s Acute Care Episode Program — which bundled payments for cardiac and orthopedic procedures — physicians worked together to choose high-quality, cost-effective devices. <a class="zem_slink" title="Baptist Health System" href="http://en.wikipedia.org/wiki/Baptist_Health_System" target="_blank" rel="wikipedia">Baptist Health System</a> in Texas, which participated in the program, used clinical evidence to choose devices and negotiated lower prices for both Medicare and non-Medicare patients.</p>
<p>States could adopt similar payment reforms for private insurance and their <a title="Recent and archival health news about Medicaid." href="http://topics.nytimes.com/top/news/health/diseasesconditionsandhealthtopics/medicaid/index.html?inline=nyt-classifier">Medicaid</a> programs. In Arkansas, the Medicaid program and private payers — including Walmart — have collaborated to adopt bundled payments for several procedures, including hip and knee replacements.</p>
<p>To complement these efforts, the new <a class="zem_slink" title="Patient-Centered Outcomes Research Institute" href="http://www.pcori.org" target="_blank" rel="homepage">Patient-Centered Outcomes Research Institute</a>, a nongovernmental body created by the Affordable Care Act, should pay for research that compares the effectiveness of devices so physicians can make informed choices. (Three years into its existence, the institute has initiated few, if any, studies of medical devices.) Medicare or the <a class="zem_slink" title="Food and Drug Administration" href="http://maps.google.com/maps?ll=39.0352777778,-76.9830555556&amp;spn=0.01,0.01&amp;q=39.0352777778,-76.9830555556 (Food%20and%20Drug%20Administration)&amp;t=h" target="_blank" rel="geolocation">Food and Drug Administration</a> should also require the use of registries that track when devices fail.</p>
<p>Currently, medical-device manufacturers allocate only a sliver of profits to research and development and often focus on “tweaks” to existing devices, without providing any evidence that they are of better quality. Competitive pressures from public and private payers would provide incentives for the industry to become more innovative, producing technologies that actually lowered costs and offered truly advanced breakthroughs.</p>
<p>Instead of using its clout to lobby against the device tax — which helped foment opposition to the Affordable Care Act — the medical-device industry needs to share the responsibility of lowering costs for patients, businesses and taxpayers.</p>

<p>Johnson &amp; Johnson has tentatively agreed to a <a class="zem_slink" title="Human settlement" href="http://en.wikipedia.org/wiki/Human_settlement" target="_blank" rel="wikipedia">settlement</a> that could reach up to $4 billion to resolve thousands of lawsuits filed by <a class="zem_slink" title="Patient" href="http://en.wikipedia.org/wiki/Patient" target="_blank" rel="wikipedia">patients</a> injured by a flawed all-metal <a class="zem_slink" title="Hip replacement" href="http://en.wikipedia.org/wiki/Hip_replacement" target="_blank" rel="wikipedia">replacement hip</a>, said two <a class="zem_slink" title="Lawyer" href="http://en.wikipedia.org/wiki/Lawyer" target="_blank" rel="wikipedia">lawyers</a> briefed on the plan.</p>

<p>A spokeswoman for the company’s <a class="zem_slink" title="DePuy" href="http://en.wikipedia.org/wiki/DePuy" target="_blank" rel="wikipedia">DePuy</a> Orthopaedics unit declined to comment on the possibility of a settlement. An announcement about the plan is expected in the coming days, the lawyers said.</p>
<p>The agreement will include those patients who have already been forced to have the device, known as the Articular Surface Replacement, or A.S.R., removed and replaced with another artificial hip, said the lawyers who spoke about the agreement only on the condition of anonymity.</p>
<p>Under the deal, each patient would receive about $350,000 on average in compensation, though that figure will vary depending on factors like a patient’s age and <a class="zem_slink" title="Disease" href="http://en.wikipedia.org/wiki/Disease" target="_blank" rel="wikipedia">medical condition</a>.</p>
<p>The precise value of the settlement is unclear because lawyers for patients are still trying to estimate how many of the 12,000 related lawsuits involve patients who had a replacement. Lawyers believe that number may be 7,000 to 8,000 cases.</p>
<p>The final cost of the deal to Johnson &amp; Johnson could rise, depending on how many claimants who received the device undergo replacement operations in the future, the lawyers said. Under the plan, patients who have not had a replacement would not receive compensation, the lawyers said.</p>

<p><a class="zem_slink" title="Manufacturing" href="http://www.wikinvest.com/industry/Manufacturing" target="_blank" rel="wikinvest">Manufacturers</a> of hip and <a class="zem_slink" title="Knee replacement" href="http://en.wikipedia.org/wiki/Knee_replacement" target="_blank" rel="wikipedia">knee replacement</a> products made many promises to consumers.  This is especially true of <a class="zem_slink" title="DePuy" href="http://en.wikipedia.org/wiki/DePuy" target="_blank" rel="wikipedia">DePuy</a> Orthopaedics, Stryker, Zimmer and other manufacturers of the new generation of joint replacement products largely marketed as <a class="zem_slink" title="Medical device" href="http://en.wikipedia.org/wiki/Medical_device" target="_blank" rel="wikipedia">medical devices</a> that would last longer and provide more flexibility than traditional joint replacement solutions.</p>
<p>Unfortunately, the marketing for many of the new hip replacement products may have turned out to be a lot of hype. In fact, many of the hip replacement products that came on the market in recent years not only fail to last longer but actually appear to have higher failure rates and may cause serious complications for many patients.  The extensive problems that patients allege they’ve experienced has even caused Consumer Reports to call for a “lemon law,” on replacement joints.</p>
<p><b>Consumer Reports Calls for a <a class="zem_slink" title="Warranty" href="http://en.wikipedia.org/wiki/Warranty" target="_blank" rel="wikipedia">Warranty</a> On <a class="zem_slink" title="Hip replacement" href="http://en.wikipedia.org/wiki/Hip_replacement" target="_blank" rel="wikipedia">Artificial Hips</a> and Knees</b></p>
<p>Consumers Union, the policy arm of <a href="http://consumerreports.org/cro/news/2013/09/replacement-hip-and-knees-need-a-lemon-law/index.htm">Consumer Reports</a>, argues that medical device manufacturers should give consumers a warranty on hip and knee replacement products, promising to replace the medical devices at no costs.  This suggestion comes at a time when as many as 20 percent of all hip replacement procedures and 10 percent of all knee replacement procedures each year are revision surgeries that are necessary because of problems with the implanted artificial joint.</p>
<p>Consumer Reports believes a warranty would both be fairer to patients who need to undergo repeated surgeries and would prompt medical device manufacturers to make sure their products are safer and more durable.</p>
<p>While this idea has merit as a method of protecting customers, unfortunately a warranty may not be enough. Those whose <a class="zem_slink" title="Joint replacement" href="http://en.wikipedia.org/wiki/Joint_replacement" target="_blank" rel="wikipedia">artificial joints</a> fail often experience significant pain and serious medical complications. A no-cost revision surgery wouldn’t compensate the victims of defective medical devices for these other losses, but a product liability claim can and does allow patients to take action for defective hip and knee replacement devices.</p>
<p><b>Patients Have Rights When Hip and Knee Products are Defective</b></p>
<p>A large part of the reason revision surgeries have become so common in recent years is that many of the newer hip replacement products are metal-on-metal devices that were brought to the market under a special <a class="zem_slink" title="Food and Drug Administration" href="http://maps.google.com/maps?ll=39.0352777778,-76.9830555556&amp;spn=0.01,0.01&amp;q=39.0352777778,-76.9830555556 (Food%20and%20Drug%20Administration)&amp;t=h" target="_blank" rel="geolocation">FDA</a> rule.</p>
<p>The FDA’s 501(K) clearance rules allow manufacturers to produce and sell medical devices with a fast-tracked approval process and minimal testing provided there are substantially similar devices on the market already. Unfortunately, many of the devices brought to market under these rules have now been recalled when it turned out the products weren’t so safe after all.</p>
<p>DePuy Orthopaedics, for example, instituted a voluntary recall of its ASR™ Hip System after data from a UK joint replacement registry indicated a higher-than-average failure rate. The Stryker Rejuvenate and ABG II Modular-Neck Hip Systems were also recalled because of high failure rates.</p>
<p>The <a href="http://www.fda.gov/medicaldevices/productsandmedicalprocedures/implantsandprosthetics/metalonmetalhipimplants/default.htm">FDA</a> continues to review the safety and efficacy record of metal on metal hip implants. The agency continues to receive adverse event reports with regard to the devices.  Commonly alleged problems include:</p>
<ul>
<li>Aseptic loosening</li>
<li>Infection</li>
<li>Bone loss</li>
<li><a class="zem_slink" title="Metallosis" href="http://en.wikipedia.org/wiki/Metallosis" target="_blank" rel="wikipedia">Metallosis</a> (a/k/a “metal poisoning”)</li>
<li>The formation of pseudo tumors</li>
<li>Decreased range of motion and limited mobility</li>
<li>Pain</li>
</ul>
<p>Patients who experience these complications deserve to have the manufacturer of their defective device pay for revision surgery.  This is not all they deserve, though, and a warranty allowing for a no-cost revision procedure doesn’t go far enough. Victims whose lives are affected by defective medical products should also be compensated for time missed from work; for pain and suffering; for emotional distress and for any reduction they experience in their quality of life.</p>

<div class="MsoNormal" style="margin-bottom:20pt;"><span style="color:#3e3d3d;font-family:'Trebuchet MS';font-size:13pt;">On August 1, 2013, a new law went into effect that’s intended to <span style="background-color:yellow;background-position:initial initial;background-repeat:initial initial;">protect patients</span> and <span style="background-color:yellow;background-position:initial initial;background-repeat:initial initial;">improve the public perception of medicine</span> and the <a class="zem_slink" title="Health system" href="http://en.wikipedia.org/wiki/Health_system" target="_blank" rel="wikipedia">health care system</a>. No, it’s not the new health care system, sometimes called “<a class="zem_slink" title="Patient Protection and Affordable Care Act" href="http://en.wikipedia.org/wiki/Patient_Protection_and_Affordable_Care_Act" target="_blank" rel="wikipedia">Obamacare</a>.” But it <i>was </i>enacted as part of <a class="zem_slink" title="Health care reform" href="http://en.wikipedia.org/wiki/Health_care_reform" target="_blank" rel="wikipedia">health care reform</a>. The<span style="background-color:yellow;background-position:initial initial;background-repeat:initial initial;">Physician Payments Sunshine Act (PPSA), originally proposed by Senators <a class="zem_slink" title="Chuck Grassley" href="http://www.grassley.senate.gov/" target="_blank" rel="homepage">Chuck Grassley</a> (R-IA) and Ed Kohl (D-WI), is intended to disclose any conflicts of interest arising from drug and device industries’ financial relationships with, or marketing to, physicians.</span></span></div>
<div class="MsoNormal" style="margin-bottom:20pt;"><span style="color:#3e3d3d;font-family:'Trebuchet MS';font-size:13pt;">Lead legislative sponsor and champion Sen. Grassley praised the final implementation of the <span style="background-color:yellow;background-position:initial initial;background-repeat:initial initial;">PPSA</span>, saying: “Disclosure brings about accountability, and accountability will strengthen the credibility of medical research, the marketing of ideas and, ultimately, the <a class="zem_slink" title="Medical practice" href="http://en.wikipedia.org/wiki/Medical_practice" target="_blank" rel="wikipedia">practice of medicine</a>.”</span><sup><span style="color:#3e3d3d;font-family:'Trebuchet MS';font-size:10pt;">1</span></sup></div>
<div class="MsoNormal" style="margin-bottom:20pt;"><span style="color:#3e3d3d;font-family:'Trebuchet MS';font-size:13pt;">The law creates the “Open Payments Program,” which <span style="background-color:yellow;background-position:initial initial;background-repeat:initial initial;">requires the drug and device industry to record, and report to the federal government, nearly every payment or gift to any doctor or <a class="zem_slink" title="Teaching hospital" href="http://en.wikipedia.org/wiki/Teaching_hospital" target="_blank" rel="wikipedia">teaching hospital</a></span>. The <a class="zem_slink" title="Federal government of the United States" href="http://en.wikipedia.org/wiki/Federal_government_of_the_United_States" target="_blank" rel="wikipedia">Federal government</a> will make this information <span style="background-color:yellow;background-position:initial initial;background-repeat:initial initial;">public in a searchable on-line database beginning on September 30, 2014;</span> the database will be updated by June 30</span><sup><span style="color:#3e3d3d;font-family:'Trebuchet MS';font-size:10pt;">th</span></sup><span style="color:#3e3d3d;font-family:'Trebuchet MS';font-size:13pt;"> each year thereafter.</span></div>

<h2>Abstract</h2>
<p>Over 400,000 total knee replacement procedures (TKR) are performed annually in the United States. This paper focuses on the development of a battery-less wireless instrumented tibial tray for performance feedback in TKR implants. The proposed instrumented tibial tray is powered internally by an integrated piezoelectric energy harvesting system. Energy is harvested during the walking of the patient when forces are exerted on the tibial component. The sensors and wireless electronics are entirely powered from the harvested energy.</p>
<p>This tibial tray is also instrumented with capacitive force sensors and an ultra low-power method to measure the capacitive force sensors. A bench top test rig is developed for testing the battery-less wireless knee replacement implant. For a person with a body weight of 55 kg, the energy harvesting system can fully charge the storage capacitors in 11 steps and can harvest an average of 1051 μJ per step.</p>
<p>To power the force measurement system for ten seconds and to transmit the data, the piezoelectric energy harvesting system must be charged before the force measurement process is initiated by a minimum of 11 steps and a minimum of two steps must be taken during the force measurement process. During the force measurement process, each force sensor is sampled at a frequency of 10 Hz for ten seconds; thereafter, all of the data is transmitted to the RF base station. The resulting capacitive force sensors adequately represented cyclic loads; however, the sensors demonstrated some issues with repeatability.</p>

<h1>FDA cracks down on all-metal <a class="zem_slink" title="Hip replacement" href="http://en.wikipedia.org/wiki/Hip_replacement" target="_blank" rel="wikipedia">hip replacements</a></h1>
<p><a href="http://earlstevens58.files.wordpress.com/2012/10/mom.png"><img class="alignleft size-medium wp-image-8852" alt="MoM" src="http://earlstevens58.files.wordpress.com/2012/10/mom.png?w=300&#038;h=227" width="300" height="227" /></a>Manufacturers who want to keep selling all-metal <a class="zem_slink" title="Hip" href="http://en.wikipedia.org/wiki/Hip" target="_blank" rel="wikipedia">hips</a> will have to prove that they&#8217;re safe and effective, according to proposed new rules from the <a class="zem_slink" title="Food and Drug Administration" href="http://maps.google.com/maps?ll=39.0353363,-76.9830894&amp;spn=0.01,0.01&amp;q=39.0353363,-76.9830894 (Food%20and%20Drug%20Administration)&amp;t=h" target="_blank" rel="geolocation">Food and Drug Administration</a>. Incredibly, for the past decade <a class="zem_slink" title="Manufacturing" href="http://www.wikinvest.com/industry/Manufacturing" target="_blank" rel="wikinvest">manufacturers</a> have been aggressively marketing the devices as being better than conventional varieties without that evidence, to the great harm of patients.</p>
<p>Last year in our report on <a href="http://www.consumerreports.org/cro/magazine/2012/04/cr-investigates-dangerous-medical-devices/index.htm">dangerous medical devices</a>, we highlighted evidence that patients with all-metal artificial hip <a class="zem_slink" title="Implant (medicine)" href="http://en.wikipedia.org/wiki/Implant_%28medicine%29" target="_blank" rel="wikipedia">implants</a> were suffering serious side effects, including pain, infections, muscle lesions, and neurological problems such as depression and deterioration of hearing and eyesight, as a result of reactions to metal debris wearing off their implants. At the end of this blog is a video highlighting one such victim, an <a class="zem_slink" title="Alaska" href="http://maps.google.com/maps?ll=64.0,-153.0&amp;spn=10.0,10.0&amp;q=64.0,-153.0 (Alaska)&amp;t=h" target="_blank" rel="geolocation">Alaska</a> orthopedic surgeon, Dr. Stephen S. Tower, whose research was cited in the the FDA&#8217;s announcement.</p>
<p>At the peak of the craze for all-metal hips in 2008, they accounted for about 40 percent of all hip replacements done in the U.S., according to new estimates by Steven M. Kurtz of <a class="zem_slink" title="Drexel University" href="http://maps.google.com/maps?ll=39.956441,-75.188686&amp;spn=0.005,0.005&amp;q=39.956441,-75.188686 (Drexel%20University)&amp;t=h" target="_blank" rel="geolocation">Drexel University</a>. He estimates about 755,000 <a class="zem_slink" title="United States" href="http://maps.google.com/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h" target="_blank" rel="geolocation">Americans</a> have been implanted with the hips. Their use has dropped dramatically in recent years as awareness of their dangers has spread.</p>
<p>The FDA regulations announced yesterday specify that once the new rules become final, likely to happen sometime later this year, manufacturers will have 90 days in which to file applications that include the results of clinical trials and other &#8220;valid scientific evidence&#8221; showing the hips are safe and effective. If they don&#8217;t, they&#8217;ll no longer be able to sell them in this country.</p>
<p>&#8220;I think it&#8217;s a good thing,&#8221; Tower told us, &#8220;but in a lot of ways it&#8217;s a formality, because the use of the devices has practically gone to zero anyway.&#8221;</p>
<p>Manufacturers we contacted yesterday said they were still studying the FDA&#8217;s proposal. <a class="zem_slink" title="NYSE: ZMH" href="http://www.google.com/finance?q=NYSE:ZMH" target="_blank" rel="googlefinance">Zimmer</a>, once a major purveyor of the all-metal hips, has stopped selling them in the U.S. because &#8220;the demand is reduced so much they&#8217;re not commercially viable,&#8221; said media spokesman Garry R. Clark.</p>
<p>If you have an all-metal hip, here are symptoms to watch out for, according to the FDA:</p>
<ul>
<li>Swelling, numbness, noise (popping, grinding, clicking or squeaking of your hip), and/or a change in ability to walk.</li>
<li>General hypersensitivity reaction (skin rash)</li>
<li>Deterioration in your hearing or eyesight.</li>
<li>Psychological status change (including depression or cognitive impairment)</li>
<li>Kidney problems</li>
<li>Thyroid dysfunction (including neck discomfort, fatigue, weight gain or feeling cold)</li>
</ul>
<p>Anyone who experiences these symptoms should seek medical attention and, in particular, consider tests that detect elevated levels of the toxic metals cobalt and/or chromium in the bloodstream.</p>

The all-metal devices have been found to wear down at an accelerated rate in some patients, potentially causing damage and deterioration in the bone and tissue around the hip. There are also concerns that they could leak traces of metal into the bloodstream, which the annual medical checks will monitor.</p>
<p>Hours before critical coverage from the <a class="zem_slink" title="BMJ" href="http://www.bmj.com/" target="_blank" rel="homepage">British Medical Journal</a> and the <a class="zem_slink" title="BBC" href="http://www.bbc.co.uk/" target="_blank" rel="homepage">BBC</a>, the <a class="zem_slink" title="Medicines and Healthcare products Regulatory Agency" href="http://en.wikipedia.org/wiki/Medicines_and_Healthcare_products_Regulatory_Agency" target="_blank" rel="wikipedia">Medicines and Healthcare products Regulatory Agency</a> (MHRA) issued new guidelines on larger forms of ‘metal-on-metal’ (MoM) hip implants. Advice on smaller metal devices or those featuring a ceramic head has not changed. Previously, guidelines suggested larger MoM implants should only be checked annually for five years after surgery. The agency now says the annual check-ups should be continued for the life of the implant. Check-ups, they say, are a precautionary measure to reduce the “small risk” of complications and the need for further surgery.</p>
<p>Together with the recent controversy over PIP <a class="zem_slink" title="Breast implant" href="http://en.wikipedia.org/wiki/Breast_implant" target="_blank" rel="wikipedia">breast implants</a>, the news has caused the media and patient groups to call for tighter regulation of medical devices, perhaps bringing the approval process into line with that of medicines. Before they can be approved for wider use drugs must undergo several years of laboratory, animal and human testing .</p>
<h2>What types of implants are involved?</h2>
<p>There are numerous designs and materials used to make <a href="http://www.nhs.uk/conditions/hip-replacement/pages/introduction.aspx">hip implants</a>. In recent days the MHRA has issued major updates to its advice on a type of metal-on-metal (MoM) hip replacement. As the name implies, MoM implants feature a joint made of two metal surfaces – a metal ‘ball’ that replaces the ball found at the top of the thigh bone (femur) and a metal ‘cup’ that acts like the socket found in the pelvis.</p>
<h2>What should I do if I have a hip implant?</h2>
<p>Consult your doctor if you do not know which type of implant you have or if you have any concerns about your hip replacement. The new guidance only applies to large head metal-on-metal implants, which have been used in only a minority of hip replacements. Patients who have MoM implants should ensure they attend any follow-up appointments as usual, and can consult the <a href="http://www.nhs.uk/conditions/hip-replacement/pages/introduction.aspx">hip implant pages on NHS Choices</a> for any further updates.</p>
<p>Consult your doctor if you have any of the following symptoms:</p>
<ul>
<li>pain in the groin, hip or leg</li>
<li>swelling at or near the hip joint</li>
<li>a limp or problems walking</li>
</ul>
<p>These symptoms do not necessarily mean that your device is failing, but they do need investigating.</p>
<p>Any changes in general health should also be reported, including:</p>
<ul>
<li>chest pain or shortness of breath</li>
<li>numbness or weakness</li>
<li>changes in vision or hearing</li>
<li>fatigue</li>
<li>feeling cold</li>
<li>weight gain</li>
<li>change in urination habits</li>
</ul>
<p>The MHRA’s updated advice concerns the type of MoM implant in which the head of the femur is 36mm or greater. This is often referred to as a ‘large head’ implant. The agency now says that patients fitted with this type of implant should be monitored annually for the life of the implant, and that they should also have tests to measure levels of metal particles (ions) in their blood. Patients with these implants who have symptoms should also have MRI or ultrasound scans, and patients without symptoms should have a scan if their blood levels of metal ions are rising. The previous guidance on this type of hip implant, issued in April 2010, advised that patients should be monitored annually for no fewer than five years.</p>
<h2>What about other types of hip implants?</h2>
<p>Advice on monitoring patients with other types of hip implants remains the same, and guidance has not changed on:</p>
<ul>
<li>MoM hip resurfacing implants – where the socket and ball of the hip bone has a metal surface applied to it rather than being totally replaced.</li>
<li>Total MoM implants where the replacement ball is less than 36mm wide.</li>
<li>A particular range of hip replacements called DePuy ASR – these hip replacements were recalled by their manufacturer, DePuy, in 2010 because of high failure rates. The company made three types of ASR implant.</li>
<li>Implants featuring ceramic heads.</li>
</ul>
<h2>How many people are affected?</h2>
<p>It is estimated that, in total, 49,000 people in the UK have been given metal-on-metal implants with a width of 36mm or above. This represents a minority of the patients given hip replacements, who mostly have devices featuring plastic, ceramics or smaller metal heads.</p>
<p>In 2010 there were 68,907 new hip replacements fitted, and approximately 1,300 of these surgeries used an MoM implant sized 36mm or above – a rate of around 2%.</p>
<h2>What exactly is the problem with MoM implants?</h2>
<p>All hip implants will wear down over time as the ball and cup slide against each other during walking and running. Although many people live the rest of their lives without needing their implant to be replaced, any implant may eventually need surgery to remove or replace its components. Surgery to remove or replace part of the implant is known as ‘revision’ and, of the 76,759 procedures performed in 2010, some 7,852 were revision surgeries.</p>
<p>However, data now suggest that large head MoM hip implants (those with a width of 36mm or greater) wear down at a faster rate than other types of implants. As friction acts upon their surfaces it can cause tiny metal particles (medically referred to as ‘debris’) to break off and enter the space around the implant. Individuals are thought to react differently to the presence of these metal particles, but, in some people, they can trigger inflammation and discomfort in the area around the implant. Over time this can cause damage and deterioration in the bone and tissue surrounding the implant and joint. This, in turn, may cause the implant to become loose and cause painful symptoms, meaning that further surgery is required.</p>
<p>News coverage has also focused on the MHRA’s recommendation to check for the presence of metal ions in the bloodstream, potentially released either from debris or the implant itself. Ions are electrically charged molecules. Levels of ions in the bloodstream, particularly of the cobalt and chromium used in the surface of the implants, may, therefore, indicate how much wear there is to the artificial hip.</p>
<p>There has been no definitive link between ions from MoM implants and illness, although there has been a small number of cases in which high levels of metal ions in the bloodstream have been associated with symptoms or illnesses elsewhere in the body, including effects on the heart, nervous system and thyroid gland.</p>
<p>The MHRA points out that most patients with MoM implants have well functioning hips and are thought to be at low risk of developing serious problems. However, a small number of patients with these hip implants develop soft tissue reactions to the debris associated with some MoM implants.</p>
<h2>How are medical devices regulated?</h2>
<p>In the UK, the MHRA is the government agency responsible for ensuring that medical devices work and are safe. The MHRA audits the performance of private sector organisations (called notified bodies) that assess and approve medical devices. Once a product is on the market and in use, the MHRA has a system for receiving reports of problems with these products, and will issue warnings if these problems are confirmed through their investigations. It also inspects companies that manufacture products to ensure they comply with regulations.</p>
<p>This system differs greatly from that for testing and approving drugs. Drugs require several years of research testing and trials before they can be approved for clinical use.</p>
<h2>What action have regulators taken?</h2>
<p>The MHRA has convened an expert advisory group to look at the problems associated with MoM implants. This meets regularly to assess new scientific evidence and reports from doctors and medical staff treating patients. The agency says it is continuing to monitor closely all the latest evidence about these devices and may issue further advice in the future.</p>
<p>In the US, the Food and Drug Administration (FDA) says it is gathering additional information about adverse events in patients with MoM implants. In the meantime, it advises patients with MoM hip implants who have no symptoms to attend follow-up appointments as normal with their surgeon. Patients who develop symptoms should see their surgeon promptly for further evaluation.</p>
<h2>What actions have critics called for?</h2>
<p>In light of the PIP breast implant controversy and this new information on hip implants, there is currently intense scrutiny on the way medical devices are regulated in the UK and Europe, with patient groups and the media arguing that medical devices should be regulated in a similar way to medicines.</p>
<p>Clearing a medicine for use in the UK is a lengthy process involving several stages of laboratory and animal testing, and then carefully controlled and monitored tests in humans. Only once there is enough evidence to suggest that a medicine is reasonably safe can it enter clinical use, and even then patients will be monitored to look at the longer-term effects of the drug.</p>
<p>However, medical devices are not required to go through human trials before entering use, and can currently be approved on the basis of mechanical tests and animal research. The average rate of revision exceeds the 1% benchmark created by the U.K.’s <a class="zem_slink" title="National Institute for Health and Clinical Excellence" href="http://www.nice.org.uk" target="_blank" rel="homepage">National Institute for Health and Clinical Excellence</a> (NICE).</p>
<p>Researchers have found that the <a title="Metal-on-Metal Hip Replacement Lawyer &amp; Lawsuits" href="http://www.schmidtlaw.com/metal-on-metal-hip-implants/">metal-on-metal hip implant</a> is associated with a 1.29% failure rate, according to the National Joint Registry of England and Wales. A separate analysis of data from the <a class="zem_slink" title="Australia" href="http://maps.google.com/maps?ll=-35.3,149.133333333&amp;spn=0.1,0.1&amp;q=-35.3,149.133333333 (Australia)&amp;t=h" target="_blank" rel="geolocation">Australian</a> Orthopaedic Association’s National Joint Replacement Registry linked the Birmingham to a 1.12% failure rate.</p>
<p>It is difficult for researchers in the <a class="zem_slink" title="United States" href="http://maps.google.com/maps?ll=38.8833333333,-77.0166666667&amp;spn=10.0,10.0&amp;q=38.8833333333,-77.0166666667 (United%20States)&amp;t=h" target="_blank" rel="geolocation">United States</a> to determine the failure rate of the Birmingham, because the <a class="zem_slink" title="Food and Drug Administration" href="http://maps.google.com/maps?ll=39.0353363,-76.9830894&amp;spn=0.01,0.01&amp;q=39.0353363,-76.9830894 (Food%20and%20Drug%20Administration)&amp;t=h" target="_blank" rel="geolocation">U.S. Food and Drug Administration (FDA)</a> lacks a tracking system for medical devices. The FDA only keeps a database of voluntarily-submitted adverse event reports.</p>
<p>Smith &amp; Nephew is also reminding healthcare professionals about several factors that increase the risk of hip implant failure and revision surgery. The risk of failure increase for patients who receive smaller component sizes (less than 46-mm), patients who require implantation at a high abduction angle, patients with osteonecrosis (bone death) in the hip, or other problems in their hip. Women of childbearing age and people who are severely obese have a higher risk of hip implant failure.</p>
<p>The company warns that patients who absolutely should not get a Birmingham hip implant include those with osteoporosis (bone loss), metabolic disorders such as kidney failure, muscle atrophy/weakness, lack of bone or soft tissue in the hip area, infection anywhere in the body, or a pre-existing metal sensitivity.</p>
<p>The safety communication warns about the risk of serious health complications. Metal-on-metal hip implants are facing heightened scrutiny by regulators around the world. The products can shed particles of metal into the body, which increases the risk of pain, inflammation, <a title="Hip Replacement Metallosis Lawsuit" href="http://www.schmidtlaw.com/hip-replacement-metallosis-lawsuit/">metal poisoning</a>, and severe irritation of surrounding tissues and bone. This can cause the formation of soft-tissue lesions, <a title="What is a Hip Implant Pseudotumor?" href="http://www.schmidtlaw.com/what-is-a-hip-implant-pseudotumor/">pseudo-tumors</a>, and fluid collections. Patients may require revisions surgery to remove, replace, or repair the implant.</p>

<p><strong>The doctor, who also worked as a consultant to Johnson &amp; Johnson, wrote the note nearly two years before the company recalled the device in 2010.</strong> And it was far from the only early warning those executives got from doctors who were paid consultants. Still, the company’s <a class="zem_slink" title="DePuy" href="http://en.wikipedia.org/wiki/DePuy" target="_blank" rel="wikipedia">DePuy</a> orthopedic unit plowed ahead, and those consultants never sounded a public alarm to other doctors, who kept implanting the device.</p>
<p>The memos have recently emerged during the trial of the first of more than 10,000 patient <a href="http://www.nytimes.com/2013/02/01/business/hip-implants-risks-inadequately-assessed-depuy-report-found-in-2010.html">lawsuits brought against Johnson &amp; Johnson</a> over the hip implant device, the Articular Surface Replacement, or A.S.R. The company has insisted that it acted responsibly in determining when to halt its sale. But plaintiffs’ lawyers have offered a portrait of executives who put profits ahead of patients, even scuttling a plan to fix the implant because it cost too much.</p>
<p>It might not be surprising to find that executives acted to protect a company’s bottom line. <strong>Still, the Johnson &amp; Johnson episode is also illuminating a broader medical issue: while experts say that doctors have an ethical obligation to warn their peers about bad drugs or medical devices, they often do not do so.</strong></p>
<p>“Questioning the status quo in medicine is not easy,” said <a href="http://medicine.yale.edu/intmed/people/harlan_krumholz.profile">Dr. Harlan Krumholz</a>, a professor at Yale School of Medicine.</p>
<p>Physicians may remain silent for a variety of reasons, he and other experts said. They may fear that speaking out could get them sued or believe that a product problem was an anomaly or their fault.</p>
<p>Doctors also have an aversion to reporting. For instance, while the <a class="zem_slink" title="Food and Drug Administration" href="http://maps.google.com/maps?ll=39.0353363,-76.9830894&amp;spn=0.01,0.01&amp;q=39.0353363,-76.9830894 (Food%20and%20Drug%20Administration)&amp;t=h" target="_blank" rel="geolocation">Food and Drug Administration</a> relies on physicians to help monitor product safety by alerting the agency to adverse patient reactions, doctors usually do not make such filings, saying they are too busy for the paperwork.</p>
<p>“The standard in the medical community is not to report,” said <a href="http://www.startribune.com/business/149299585.html?refer=y">Dr. Robert Hauser</a>, a cardiologist who, along with a colleague, warned other doctors in 2005 about a defective heart implant.</p>
<p><strong>There is another reason doctors may choose to remain silent, experts say: their financial ties to a drug or device maker.</strong></p>
<p>For years, such consulting payments have raised concerns about the impact of money on a doctor’s decision about which drugs to prescribe or how to interpret research findings. Money can also shift a physician’s sense of loyalty, said <a href="http://www.cmu.edu/dietrich/sds/people/faculty/george-loewenstein.html">George Loewenstein</a>, a professor at <a class="zem_slink" title="Carnegie Mellon University" href="http://maps.google.com/maps?ll=40.443322,-79.943583&amp;spn=0.01,0.01&amp;q=40.443322,-79.943583 (Carnegie%20Mellon%20University)&amp;t=h" target="_blank" rel="geolocation">Carnegie Mellon University</a> who has studied medical conflict-of-interest policies. “If someone has been paying you or employing you, it is very difficult to blow the whistle,” said Professor Loewenstein, who teaches economics and psychology. “It offends our sense of loyalty.”</p>
<p>Dr. Krumholz said he also believed that such loyalties were between a doctor and a company’s executives, rather than with a company or its brand. Over time, a physician may come to see his relationships with those officials in terms of friendship, while companies see an influential doctor as an asset who helps develop products and boost sales.</p>
<p>For a consultant, breaking those ties can carry a cost. For example, when Dr. Lawrence D. Dorr, an orthopedic specialist, warned fellow surgeons in an open letter in 2008 that a hip implant made by <a class="zem_slink" title="Zimmer Holdings" href="http://www.zimmer.com/" target="_blank" rel="homepage">Zimmer Holdings</a> was flawed, he became the subject of a whisper campaign that questioned his skills as a surgeon.</p>
<p>“The first thing that a company does is to put out a campaign that a surgeon does not know how to operate,” said Dr. Dorr, who was a consultant to Zimmer when he wrote the letter. “It hurt my practice for a year.”</p>
<p>TRADITIONALLY, doctors have brought problems to the attention of colleagues by conducting research and publishing their findings in a medical journal. The advantage of that system helps ensure the credibility of study data and protects a researcher from random attack, said <a href="http://www.commonwealthfund.org/Bios/B/Blumenthal-David.aspx">Dr. David Blumenthal</a>, the president of the <a class="zem_slink" title="Commonwealth Fund" href="http://en.wikipedia.org/wiki/Commonwealth_Fund" target="_blank" rel="wikipedia">Commonwealth Fund</a>, a group that studies health policy issues.</p>
<p>But getting a study published can take a year or two; some Johnson &amp; Johnson consultants did publish studies about the hip’s flaws, but they largely appeared after it had been recalled.</p>
<p>Dr. Blumenthal said there was probably a need for more immediate ways for doctors to share their concerns, like forums supported by professional medical organizations. Another approach would be to have companies hire doctors as consultants whose sole concern was product safety, Professor Loewenstein said.</p>
<p>The results of not speaking out are playing out in a <a class="zem_slink" title="Los Angeles" href="http://maps.google.com/maps?ll=34.05,-118.25&amp;spn=0.1,0.1&amp;q=34.05,-118.25 (Los%20Angeles)&amp;t=h" target="_blank" rel="geolocation">Los Angeles</a> courtroom, where the first Johnson &amp; Johnson hip case is unfolding. In the years before the implant’s recall, a British physician, <a href="http://www.nytimes.com/2010/12/17/business/17hip.html?pagewanted=all">Dr. Antoni Nargol</a>, and a colleague were among those who tried to alert surgeons to the problem.</p>
<p><strong>But the silence of other doctors apparently gave company executives the upper hand; in meetings with Dr. Nargol, they said that he seemed to be the only doctor having trouble.</strong></p>
<p>He said recently, “They told me there were no other problems.”</p>

<p>For four years after she had her hip replaced in 2006, Sandy Rotenberg still had increasing pain, but her doctor kept telling her everything looked normal and prescribed more pain pills.</p>
<p>Then in October 2010, during a visit to get a cortisone shot, a different doctor looking at the <a class="zem_slink" title="El Cerrito, California" href="http://maps.google.com/maps?ll=37.9158333333,-122.311666667&amp;spn=0.1,0.1&amp;q=37.9158333333,-122.311666667 (El%20Cerrito%2C%20California)&amp;t=h" target="_blank" rel="geolocation">El Cerrito</a> woman&#8217;s X-ray commented that her implant appeared to be one of the faulty all-metal devices made by <a class="zem_slink" title="Johnson &amp; Johnson" href="http://maps.google.com/maps?ll=40.498504,-74.44356&amp;spn=0.01,0.01&amp;q=40.498504,-74.44356 (Johnson%20%26%20Johnson)&amp;t=h" target="_blank" rel="geolocation">Johnson &amp; Johnson</a>&#8216;s <a class="zem_slink" title="DePuy" href="http://en.wikipedia.org/wiki/DePuy" target="_blank" rel="wikipedia">DePuy</a> unit that the company had recalled that August.</p>
<p>&#8220;I felt sick, terrified, but I also felt relieved,&#8221; said Rotenberg, 53, who was born with a hip abnormality that caused early deterioration and arthritis. &#8220;I&#8217;d been hearing this attitude that was pretty paternalist and made me feel like this hysterical female. In some ways, it was just this huge relief to find out what was wrong.&#8221;</p>
<p>Turns out Rotenberg was one of more than 93,000 patients worldwide to be implanted with DePuy&#8217;s metal-on-metal <a class="zem_slink" title="Hip replacement" href="http://en.wikipedia.org/wiki/Hip_replacement" target="_blank" rel="wikipedia">replacement hip</a>, known as the articular surface replacement.</p>
<p>Metal-on-metal implants, in which the cup and ball are made of metal, have been on the market for decades. DePuy&#8217;s version, marketed to younger patients because it would last longer than conventional hip implants, came on the U.S. market in 2005. It not only failed in many patients but released tiny fragments of metal into the patients&#8217; bodies, causing tissue damage and other complications.</p>
<h2>Untested devices</h2>
<p>Considered one of the largest device failures in decades, the DePuy debacle highlights a little-known but stunning truth: These devices were cleared by the <a class="zem_slink" title="Food and Drug Administration" href="http://maps.google.com/maps?ll=39.0353363,-76.9830894&amp;spn=0.01,0.01&amp;q=39.0353363,-76.9830894 (Food%20and%20Drug%20Administration)&amp;t=h" target="_blank" rel="geolocation">U.S. Food &amp; Drug Administration</a> without having to be tested in a single human being.</p>
<p>How does that happen? A loophole in FDA rules allow certain high-risk devices, including metal-on-metal hip implants, to bypass pre-market testing requirements if their manufacturers can convince the regulators that their device is &#8220;substantially equivalent&#8221; to a device already on the market.</p>
<p>A growing number of health experts, lawmakers and regulators are trying to close that gap.</p>
<p>&#8220;I don&#8217;t think we should have devices on the market until we already know they are safe and effective,&#8221; said Dr. Rita Redberg, a <a class="zem_slink" title="University of California, San Francisco" href="http://maps.google.com/maps?ll=37.7633194444,-122.458538889&amp;spn=0.01,0.01&amp;q=37.7633194444,-122.458538889 (University%20of%20California%2C%20San%20Francisco)&amp;t=h" target="_blank" rel="geolocation">UCSF</a> professor of medicine who co-authored an article in the <a class="zem_slink" title="The New England Journal of Medicine" href="http://www.nejm.org/" target="_blank" rel="homepage">New England Journal of Medicine</a> last month calling for a change in FDA regulations. &#8220;Pre-market (clinical) trials would have caught the problem and 93,000 people would not have been implanted with a device that has since been recalled.&#8221;</p>
<p>The rule that has allowed certain devices to skirt the process of undergoing potentially lengthy and expensive clinical trials dates to 1976, when the FDA started regulating medical devices, which include everything from heart defibrillators to infusion pumps to toothbrushes.</p>
<p>While the FDA requires implantable heart defibrillators and most other highest-risk devices to go through trials, it created a temporary approval process known as the 510(k) program as a stopgap measure to cover devices the agency had not yet classified for their level of risk.</p>
<h2>Loophole never closed</h2>
<p>This process would allow the FDA to clear these devices by deeming them similar enough to products already on the market. But the loophole was never closed and a number of devices, including metal-on-metal hip implants, have relied on the rule to get on the market.</p>
<p>The FDA has made several attempts over the years to classify metal-on-metal hips, but never completed the process. The agency restarted the effort on Jan. 18 under new rules passed last year designed to make device classification more streamlined.</p>
<p>For as long as the loophole exists, Dr. Kevin Bozic, chairman of the UCSF&#8217;s department of orthopedic surgery, said better monitoring of devices after they are already on the market would help identify problems as they occur.</p>
<p>&#8220;There are always going to be devices that fail before there are millions of them out there. What we need to do is find about them earlier in the process,&#8221; said Bozic, also chairman of the <a class="zem_slink" title="American Academy of Orthopaedic Surgeons" href="http://en.wikipedia.org/wiki/American_Academy_of_Orthopaedic_Surgeons" target="_blank" rel="wikipedia">American Academy of Orthopaedic Surgeons</a> Council on Research and Quality.</p>
<p>Bozic is working to create a registry to track patients who have undergone hip and knee replacements in the United States, a move that could be done independently of federal action.</p>
<p>Meanwhile, the problem persists. And now Johnson &amp; Johnson&#8217;s hip replacement device has landed in court. A Southern California jury is hearing evidence in the first DePuy case to reach trial. But many more are expected to follow.</p>
<p>More than 10,000 lawsuits have been filed by patients nationwide who have suffered a range of injuries, with some having to undergo multiple surgeries to try to repair the damage. Financial damages have yet to be determined and will depend on the level of injury.</p>
<p>Many of the lawsuits name two orthopedic surgeons who were on the design team for DePuy&#8217;s ASR implant and reportedly received millions of dollars in royalties for their work: Dr. Thomas Schmalzried, who practices in Los Angeles, and Dr. Thomas Vail, an orthopedic surgeon at UCSF. Neither UCSF nor Vail would comment.</p>
<h2>Plaintiffs&#8217; accusations</h2>
<p>San Francisco attorney Lexi Hazam, whose firm is representing about 160 plaintiffs, said DePuy not only created a product that it did not adequately test, but it also failed to notify doctors, patients and regulators as soon as the problems became apparent.</p>
<p>&#8220;Serious flaws with the device became apparent quickly,&#8221; said Hazam, a partner with the national plaintiffs&#8217; firm Lieff, Cabraser, Heimann &amp; Bernstein LLP. &#8220;The company left the product on the market despite knowledge of these flaws.&#8221;</p>
<p>Officials from DePuy, for their part, said they decided on the voluntary recall in 2010 after data showed that 12 or 13 percent of patients in the United Kingdom needed surgery to fix problems with their implants after five years.</p>
<p>&#8220;We understand that the August 2010 ASR Hip System recall is concerning for patients, their family members and surgeons,&#8221; the company said. &#8220;Since the recall decision was made, DePuy has worked to provide patients and surgeons with the information and support they need.&#8221;</p>
<p>The help may come too little and too late for patients like Rotenberg.</p>
<h2>Not fully recovered</h2>
<p>Rotenberg, a librarian at Solano Community College, underwent a second surgery to replace the recalled device in January 2011. Then she had to endure yet another surgery in December 2011 to replace the second device after her damaged tissue prevented her bone and ligaments from adhering to the implant. She expects to have to have that implant replaced in the future.</p>
<p>&#8220;My body still doesn&#8217;t seem to be healing very well in that I&#8217;m still in considerable pain,&#8221; she said, adding that she uses a cane to walk more than very short distances. &#8220;My husband is still tying my shoelaces because I can&#8217;t bend over.&#8221;</p>
<p>Rotenberg, who is being represented by Hazam&#8217;s firm in a lawsuit against the manufacturer, found it challenging to calculate the financial, physical and emotional toll the six years of pain have taken on her and her family.</p>
<p>&#8220;The years I kept going back and saying something&#8217;s wrong, they could have let my surgeon know there was a problem. If they had replaced it within a year after the first surgery, I would probably be OK,&#8221; Rotenberg said. &#8220;The damage just didn&#8217;t happen once. It kept getting worse and worse. They knew. They knew even more every day that passed.&#8221;</p>
