The Birmingham was approved through the FDA PMA ( pre-marketing approval ) process, which gives it pre-emption laws as it’s protection against prosecution.
This will be a tough legal battle, if you have been hurt by this device, be tough, do not throw in the towel, fight for what has been taken away from or this type of nightmare
will continue to hurt people. It is up to me and you to see the laws are changed, the CORRUPTION is removed and Smith and Nephew are held accountable for what they have done.
Remember this company is a repeat offender of the kickback laws and they have
paid several Governments fines, including the USA, they are in court being sued by the United States of America on a whistleblower case.
They continue to market the bhr as if nothing has happened, the I ask why are their sales down in the USA and other countries dramatically???
They have recalled the liner on their R3 ace tabular hip, recalled another component on their bhmr.
Their marketing statements compare their bhr as being much more successful than
competition, yet what is there competition??? Although they out sell all other resurfacing devices, if you read the number of registered adverse complaints, you will see that the adverse numbers have increased dramatically from years passed.
Why, because as time passes from the pma approval of this device more and more innocent folks are now becoming victims of a device that can be most hazardous to one’s health.
Know that there is something inside of you that is greater than any obstacle, remember David and Goliath, this manufacture must be held accountable for the
damage, harm, pain and suffering they have caused on innocent folks, JUSTICE
needs to be served.
