FORT WORTH, Texas, July 9, 2012 /PRNewswire/ — A motion was filed on June 27, 2012 with the United States Judicial Panel on Multidistrict Litigation (JPML) petitioning for the creation of a coordinated federal MDL for all personal injury cases concerning the Biomet M2a Magnum metal-on-metal hip replacement system. The motion requests that all pending cases and future claims relating to the Biomet M2a Magnum device be transferred and consolidated in the United States District Court for the Northern District of California or alternatively, the United States District Court for the Southern District of New York. The United States Judicial Panel on Multidistrict Litigation will decide whether consolidation is appropriate in this matter. There are currently four MDLs involving metal-on-metal hip replacement systems, including the DePuy ASR, DePuy Pinnacle, Zimmer Durom and Wright Conserve.

The Biomet M2a Magnum System is a metal-on-metal device used for primary and revision hip replacement. The device was approved by the U.S. Food and Drug Administration (FDA) through the 510(k) process on October 1, 2004. It is composed of a cobalt-chromium-molybdenum (CoCrMo) metal cup and CoCrMo metal head. According to Biomet, 112,412 M2a units were implanted in patients from 1999 to 2009.

Possible adverse events related to implantation of this system include metal sensitivity reactions and elevated metal ion levels. Over 450 adverse event reports regarding this hip device have been submitted to the FDA since the device was approved for sale in the U.S. These reports include patients’ experiences with elevated metal ion counts and pseudotumors after being implanted with the Biomet M2a Magnum device. According to data from the Australian Orthopaedic Association National Joint Replacement Registry’s 2011 Annual Report, this device has a revision rate of 7.2% at the seven-year mark.

The motion seeking to establish a MDL docket references nine pending cases in six different districts across the country.
