How do we sue for a Biomet hip replacement failure?
My wife required revision surgery to replace a Biomet metal on metal hip replacement that failed after 6 years with the same issues as the DePuy metal on metal hip. She has suffered permanent damage. Can you give me advice on pursuing a lawsuit against Biomet for the issues with this defective device?

1/15/04 total r-hip Biomet Metal on Metal 38mm , revision on 8/18/05 the cup came loose , metalosia debris. Will Biomet get a recall??

I think that as long as the revision rates are under about 5 – 7% the companies seem to get away with it.
I guess the logic is that some failures will always happen – just like my problems with the Smith & Nephew Birmingham Spectron – don’t hear about too many problems but I am sure they are out there or the recipients just live with the pain.
If you live in the USA and you have all your medical records, with the current focus on metal on metal problems, the last thing Biomet will want is to be dragged into the legal warfare and so they might make you a nice payment to go away…
Needing a revision after a year is absolutely drastic.

I had a BioMet hip Resurfacing Surgery in 2005 that failed after 3 Months. I also developed an A-Typical Mycobacterium Infection in the joint. Had to have a Total Hip replacement in 2006; a BioMet Mallory Custom Cup. This failed about 6 months later. Had another Total Hip done in 2008; also a BioMet implant. I am a little over 3 years post op and I am now getting a call from my Orthopaedist office that I need to have a Metal ION blood test done. Curious to know your thoughts on my situation.

I had a left hip replacement in march 2010, so not even 2 years ago, i am 46 and the pain i live with is crazy! the metals in my bloodwork are already elevated, not a dangerous high but never the less, it should not be that way. i cannot believe this biomet metal on metal has not been recalled yet because there are so many people out here with issues from it. anyone else going thru this so soon? I feel like a 46 year old in a 90 year old body driving me nuts!!

I’d like to know that one, too. I have a lawsuit filed against Biomet- I had a Magnum hip replacement in 2006, told it would last me a lifetime. Dec. of 2011, I had to have revision surgery because I had developed Metallosis from it. I had tissue necrosis, and thankfully I had a wonderful Dr. who took immediate action before my bone had severe erosion. I think the company should warn everybody of this danger before they have the hip put in their body, and I encourage everyone who has one to have their Dr. do a chromium/cobalt blood testing on them. I had to have emergency surgery during the holidays.

Biomet resurfacing 2005. 2008 pain, swelling, immobility. Appointments with 5 Orthopods, two drew 90 cc and 120 cc of blood from swollen hip. All 5 said device properly placed and not loose. Extensive tests for metal inconclusive. Each said they had never seen the symptoms before. Revision to Smith & Nephew with plastic cup liner 2009. Hip is still very painful. Revision surgeon, continues to say the pain will improve, but after 2.5 years still the same.

I don’t know what some surgeons read. Not much it seems. The answers appear obvious to a blind man but it seems tha a number of surgeons just don’t want to know and deliberately overlook the truth.
Why your hip is still sore is not clear unless the prosthesis is somehow impinging on the surrounding tissue?
Have you seen another surgeon for a second opinion?

Ok. It may be just a poor design hip. I had nothing but pain from my Smith & Nephew Birmingham Spectrum THR from day one. Sure it was metal on metal but essentially the same as the one you have I think?
The revised hip I have now is a Zimmer ceramic on ceramic and it is pain free 90% of the time. The range of movement is 10 times better than the S&N hip. So maybe it is the design ?
Do things like Voltaren help? Why I ask this is because if they do it suggests to me that the hip is irritating the surrounding muscle?
